This Acceptable Use Policy (“Policy”) outlines the rules for using Alpha1 HVAC Services, LLC. (“Alpha1 HVAC”, “we”, “us”, or “our”) platforms and services (collectively, the “Services”). The examples below are not exhaustive.
We may take action, including suspension or termination of your access to the Services, if, at our discretion, we believe you have violated this Policy directly or indirectly, or authorized others to do so.
This Policy may be updated periodically by posting a revised version on our website. By using the Services, you agree to the latest version of this Policy.
General Policies & Requirements
To ensure a reliable experience, it’s essential to prevent unwanted communications by only sending messages that comply with relevant laws and industry standards. All communications (e.g., SMS, MMS, webchat, and voice) must comply with this Policy, covering consent, sender identification, usage guidelines, prohibited content, and enforcement.
Consent Requirements
Standard Consent: Before messaging anyone, you must have their explicit consent. This consent should be documented per local regulations. Consent is exclusive to Alpha1 HVAC and specific to the messages agreed upon; it cannot be transferred, purchased, or treated as blanket permission.
Alternative Consent: In some cases, consent may be implied. For instance, if someone messages Alpha1 HVAC directly (e.g., inquiring about service hours), their message serves as consent for a direct reply. Similarly, if a prior customer provides their contact for service updates (e.g., appointment reminders), you may message them as needed, provided it’s non-promotional and they haven’t opted out.
Ongoing Consent
For ongoing communications, provide a reminder on how recipients can unsubscribe and respect their preferences regarding message frequency. Regularly reconfirm consent following local regulations and best practices.
Sender Identification
All messages must clearly indicate that Alpha1 HVAC Services is the sender, except in replies within ongoing conversations.
Opt-Out
Include opt-out instructions like “Reply STOP to unsubscribe” in initial messages. Individuals may revoke consent anytime by responding with an opt-out keyword. Upon receiving an opt-out, send one confirmation message and cease further messaging unless consent is renewed.
Prohibited Content and Activities
You agree not to use Alpha1 HVAC’s Services for communications that contain or relate to:
- Unsolicited Advertisements: Any spam or promotional messages without recipient consent.
- Illegal or Harmful Content: Messages promoting illegal, fraudulent, or harmful activities (e.g., child exploitation, pyramid schemes, high-risk financial services, or regulated substances).
- Infringing Content: Any materials infringing on others’ intellectual property rights.
- Offensive or Harmful Content: Messages that are defamatory, obscene, abusive, invasive of privacy, or contain malware or harmful technologies.
- Message Evasion Tactics: Using tactics to avoid detection, such as intentional misspellings or unrecognized opt-out phrases, or spreading identical messages across multiple phone numbers.
Monitoring, Enforcement, and Reporting
We reserve the right to monitor and investigate any misuse of the Services. Alpha1 HVAC may remove or restrict access to content or users violating this Policy and report illegal activities to law enforcement as appropriate.
If you identify any Policy violations, please notify us promptly and provide assistance as needed to remedy the issue.
